Black Hawk Tavern License Renewed

The Black Hawk Tavern's liquor license and amusement permit were both approved by Wiscasset selectmen Tuesday night.

The entertainment permit, according to George Freeman, treasurer of The Franklin Clark House LLC, owners of the tavern at The Ledges on Main Street, is to allow dinner music at the restaurant.

Granting of the two licenses prompted questions at a previous selectmen's meeting because the business, although located in the village, is in the residential zone.

At the board's August 24 meeting, Appeals Board chairman Susan Blagden corrected a mistake in a previous Wiscasset Newspaper article which reported that hours of operation for businesses located in a residential zone are supposed to end at 7 p.m. Blagden said the 7 p.m. restriction applies "only when an existing nonconforming use is changed to another nonconforming use with a permit from the Board of Appeals."

Blagden said, as chairman of the Board of Appeals, "I can tell you that this has happened exactly once since the ordinance was enacted." She also took issue with a statement by selectman Karl Tarbox that she had submitted the original ordinance.

"The ordinance in question was developed by the Ordinance Review Committee, of which I was then the chairman, at the request of the selectmen," she said.

"The requirement does not apply to permitted nonresidential uses in the residential district, such as professional buildings, nor does it apply to grandfathered nonconforming uses," she said.

Tarbox had cited a funeral home on Federal Street as an example of a business that operates after 7 p.m., in violation of the ordinance. However, Blagden said, this business is not subject to the 7 p.m. hours of operation because it falls into the grandfathered nonconforming use category.

Tarbox had called for the Ordinance Review Committee to take another look at the ordinance to see if it made sense to keep it. He said his mother, who operates a seasonal yarn shop on Federal Street, received a letter years ago from the town attorney saying she could not have knitting classes after 7 p.m.
